SANFORD, Fla. (AP) _ An attorney for a central Florida woman accused of strangling her 2-year-old daughter with her bra says he plans to ask a judge to toss out her confession.
Tim Caudill told the Orlando Sentinel (http://thesent.nl/ADX0f5 ) he will tell Circuit Judge Jessica Recksiedler Monday that 24-year-old Nioshka Bello couldn’t have known she had the right to remain silent when she confessed while locked in a mental hospital.
She is accused in the September 2009 death of Janessa Sandoval.
Casselberry Police say Bello tried to kill herself with pills before strangling Janessa after getting into a fight with the girl’s father.
The newspaper reports Bello believed she would be left homeless the next day.
Bello has twice been sent to mental hospitals.
Last week the judge ruled her competent to stand trial.
