Couple Wins Fight For Homegrown Garden

A Miami couple, Hermine Rickets and Tom Carroll, were attacked by the state to get rid of their garden they were using to grow fresh vegetables. They had been doing so for the past 17 years.

The problem was it was located in their front yard because they claim their front yard doesn’t get enough sunlight.

This spurred a new zoning ordnance that was designed to ‘protect the distinctive character of the Miami Shores Village’ and it prohibited vegetables.

Soon after, the couple was visited by the local code enforcement officer and presented two choices, get rid of the garden or pay $500 a day to keep it.

They appeared before the Code Enforcement Board and were denied exemption twice and they decided to get rid of the garden rather than pay the fine.

But they kept fighting the ordinance and won. They’re now allowed to keep the garden.
